Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website, applications, and services ("Platform") operated by Fursat Farms Private Limited (CIN: U55101WB2023PTC266520), trading as Fursat ("we", "us", "our", "Fursat").

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Definitions

  • "Platform" means the website at fursat.fun, related mobile applications, and all associated services.
  • "Guest" means any user who browses, searches for, or books accommodation or travel experiences through the Platform.
  • "Host" means any property owner or manager who lists accommodation on the Platform.
  • "Listing" means a property or travel experience made available for booking through the Platform.
  • "Booking" means a confirmed reservation of a Listing made through the Platform.
  • "Content" means text, images, reviews, descriptions, or other material uploaded to or displayed on the Platform.

2. Platform Role — Intermediary

Fursat operates as an online intermediary marketplace under Section 2(1)(w) of the Information Technology Act, 2000. We connect Guests with Hosts but do not own, operate, manage, or control any listed property. The contractual relationship for accommodation is between the Guest and the Host directly. Fursat facilitates discovery, booking coordination, and payment processing as a service.

We are not a hotel, tour operator, or travel agent. We do not guarantee the quality, safety, legality, or suitability of any Listing.

3. Eligibility

You must be at least 18 years of age and legally competent to enter into contracts under the Indian Contract Act, 1872 to use the Platform. By using the Platform, you represent that you meet these requirements. Persons under 18 may not create accounts or make bookings.

4. Account Registration

  • You must provide accurate, current, and complete information during registration.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately of any unauthorised use of your account.
  • We may suspend or terminate accounts that violate these Terms.

5. Bookings and Payments

  • All bookings are subject to availability and Host confirmation.
  • Prices displayed include applicable taxes unless stated otherwise. GST is charged as applicable.
  • Payment is processed through our platform or via bank transfer / UPI as indicated during checkout.
  • Service fees, if any, will be clearly disclosed before you complete a booking.
  • Once confirmed, bookings are subject to our Cancellation & Refund Policy.

6. User Conduct

By using the Platform you agree not to:

  1. Post content that is false, misleading, defamatory, obscene, or harmful.
  2. Post content that threatens the unity, integrity, defence, or security of India, or public order.
  3. Post content that is invasive of another person's privacy.
  4. Post content that is harmful to minors in any way.
  5. Infringe any intellectual property rights, patent, trademark, or copyright.
  6. Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  7. Post content that contains software viruses or malicious code.
  8. Engage in activities that constitute a criminal offence under applicable law.
  9. Use the Platform for any unlawful purpose.
  10. Harvest or collect personal information of other users without their consent.
  11. Interfere with or disrupt the Platform or servers connected to it.

This list is required under Rule 3(1)(b) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and is not exhaustive.

7. Host Obligations

Hosts represent and warrant that:

  • They have the legal right to list the property (via ownership, lease, or authorisation).
  • The Listing description, photos, and amenities are accurate and not misleading.
  • The property complies with all applicable local laws, building codes, and safety regulations.
  • They will maintain the property in a safe, clean, and habitable condition.
  • They will comply with guest registration requirements, including Form C for foreign nationals (Registration of Foreigners Act, 1939).

Hosts are solely responsible for the accuracy of their Listings and their legal compliance. See the Listing Agreement for detailed host terms.

8. Intellectual Property

All content on the Platform — including logos, text, images, design, and software — is owned by or licensed to Fursat and protected under applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

By uploading Content to the Platform, you grant Fursat a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and distribute that Content in connection with operating and promoting the Platform.

9. Limitation of Liability

  • Fursat is not liable for the acts or omissions of Hosts, Guests, or third parties, including but not limited to property condition, service quality, transportation delays, cancellations, or personal injury.
  • Fursat provides the Platform on an "as is" and "as available" basis without warranties of any kind.
  • To the maximum extent permitted by law, Fursat's total liability for any claim arising from or related to these Terms shall not exceed the amount paid by you to Fursat in the 12 months preceding the claim.
  • We recommend Guests obtain travel insurance for unforeseen events.

10. Indemnification

You agree to indemnify and hold harmless Fursat, its directors, officers, and employees from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Platform, your violation of these Terms, or your infringement of any third-party rights.

11. Force Majeure

Fursat shall not be liable for any delay or failure to perform its obligations where such delay or failure results from events beyond our reasonable control, including natural disasters, pandemics, government orders, wars, strikes, internet outages, or acts of God.

12. Dispute Resolution

  • These Terms are governed by the laws of India.
  • Any dispute arising from these Terms shall first be attempted to be resolved through amicable negotiation.
  • If unresolved within 30 days, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration at Siliguri, West Bengal.
  • The arbitration shall be conducted by a sole arbitrator appointed mutually by the parties.
  • Nothing in these Terms restricts your right to approach the appropriate Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019.
  • Subject to the above, courts at Siliguri, West Bengal shall have exclusive jurisdiction.

13. Grievance Redressal

In accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and the Consumer Protection (E-Commerce) Rules, 2020, we have appointed the following Grievance Officer:

  • Complaints will be acknowledged within 24 hours of receipt.
  • Complaints will be resolved within 15 days of receipt, or such extended period as may be necessary with notice to the complainant.
  • For consumer complaints under the Consumer Protection Act, 2019, acknowledgment will be provided within 48 hours and resolution within 1 month.

14. Modification of Terms

We may update these Terms at any time. Material changes will be notified via email or a prominent notice on the Platform. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms. We will inform users of any policy changes at least once annually.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
