What about what the decree set up?

Real Decreto 1312/2024 implemented EU Regulation 2024/1028 on short-term rental data. It created a single national registry of rentals (the Registro Unico de Arrendamientos) with a registration number hosts had to obtain before advertising, and a national digital gateway (the Ventanilla Unica Digital de Arrendamientos) through which platforms send data. It entered into force on 2 January 2025, with provisions taking effect on 1 July 2025.

What about what the supreme court annulled?

Three judgments, published in the BOE on 8 June, 26 June and 18 July 2026, reached the same core result: the provisions that create the national registry procedure and its registration number are null. That covers the host duty to obtain a number before offering a unit (article 5), the registry and the application and verification procedure (articles 8, 9 and 10), the registrar's role as competent authority (article 12 b), and the registry-related parts of articles 1, 2 and 6, plus any other men

What about what the judgments did not annul?

The judgments dismissed the rest of the appeals. Per the Judiciary's note and the operative parts, the national digital gateway, the duties on platforms to send activity data for statistics, and the definitions survive, as does the split of competence between the Ministry and regional or local authorities. Regional and municipal tourist licences were never part of this decree and are unaffected.

What about what this means for a host?

- A national registry number is no longer something the annulled articles require. We found no official post-judgment guidance on how or when this takes effect, or on whether a replacement rule is coming, so do not treat that as final. - Your regional or municipal tourist-rental licence or registration still applies. In Spain that is where the real rules sit, and they differ by community and often by city. - Platforms may still ask for a regional licence number. Check what the platform requires

Is a national registration number required right now?

The decree provisions that required one were declared null by three Supreme Court judgments in 2026. We found no official guidance on transition or on any new national rule, so confirm with the Ministry of Housing or your regional authority.

Does the decree replace regional tourist licences?

No. Regional and local licensing is separate and unaffected.

Does the national platform data reporting still apply?

The judgments did not annul the national digital gateway or the platform data duties, per the Judiciary's note on the 19 May ruling. Platforms handle this, not individual hosts.

Where do I find the actual rule for my property?

Your autonomous community's tourism department and your town hall. Ask for the current tourist-rental registration requirement for your property type.

What about once you are legal?

Registration makes you legal. Distribution makes you earn.
