What about what the act says a hotel is?

A "hotel" is an accommodation established for business purposes of providing temporary accommodation to travellers or others in exchange for compensation. The definition excludes:

What about if you do need a licence?

- Section 15: No person may operate a hotel business without a licence from the Registrar. The Registrar is a person appointed by the Minister of Interior. - Applicant: At least 20 years old, with a domicile or residence in Thailand, not bankrupt, not incompetent, with no listed convictions, and not previously revoked within three years. - Process: The Registrar checks the application and tells you of any defects within five working days. The Registrar notifies the grant or refusal within thirty

What about duties of a licensed operator?

The manager must record lodgers in a registration card at check-in, within 24 hours, and keep the records for at least one year ready for inspection. The Act also requires fire prevention systems, environmental care and help for lodgers in a fire, flood or other danger.

What about penalties?

Operating without a licence carries imprisonment of up to one year or a fine of up to THB 20,000, or both, plus up to THB 10,000 a day while the violation continues. Administrative fines for licensed operators range from THB 5,000 to THB 500,000 depending on the breach.

What about what this guide does not tell you?

It does not state which small homestays are excluded, the fees (the Act sets a ceiling by attached schedule that we did not retrieve), rules on foreign ownership of land, or any rule on visas. Those need to be checked against Thai-language sources and an adviser.

Does a small homestay need a hotel licence?

That depends on the Ministerial Regulation made under Section 4(3). The Act itself does not decide it. Confirm with the district office.

Does a monthly rental need a licence?

The Act excludes accommodation provided for a monthly service charge or upward only from the definition of hotel.

How long does a hotel licence last?

Five years from issue, for the specified hotel only.

What are the penalties for running a hotel without a licence?

Up to one year in prison or a fine up to THB 20,000, or both, plus up to THB 10,000 per day of continued violation.

Can a foreigner hold the licence?

The Act requires only a domicile or residence in Thailand for an individual applicant. It does not address foreign land ownership, which is outside this Act.
